TrackRecord is a trading name of Excited Atom Limited, a Limited company registered in the UK. Registration number 7705630. Excited Atom provides TrackRecord and its related services ("Service") subject to your compliance with the terms and conditions ("Terms of Service") set forth below. Please read the following carefully. Excited Atom reserves the right to update and modify the Terms of Service at any time without notice. New features that may be added to the Service shall be subject to the Terms of Service. Should you continue to use the Service after any such modifications have been made, this shall constitute your agreement to such modifications.
TrackRecord is a computer-based time-tracking application from Excited Atom. Your use of the Service is at your sole risk. The service is provided on an AS IS and AS AVAILABLE basis.
You must be at least thirteen (13) years of age to use this Service. You must provide your current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service. You are responsible for maintaining the confidentiality of your Service by ensuring the Authentication tokens supplied by Basecamp are kept secure. Excited Atom reserves the right to refuse service to anyone at any time without notice for any reason.
You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to:
Violation of any of the foregoing may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences.
A single one-off payment will be required to purchase a single licence of TrackRecord. Each licence purchased is to be used on one machine only. The cost for this application can be increased or decreased at any time without prior notification.
Excited Atom own the intellectual property rights to any and all protectable components of the Service,
including but not limited to the name of the Service, artwork and end-user interface elements contained within the
Service, many of the individual features, and the related documentation. You may not reverse engineer, decompile, copy,
modify, adapt, reproduce, distribute or dissemble any aspect of the Service which Excited Atom owns.
Excited Atom claims no intellectual property rights over the Content you upload or provide to the Service.
You understand that the Service can be used for transmission of your Content, and that during processing, all information
required to update Basecamp will be transferred unencrypted over the internet.
Excited Atom makes no warranties regarding (i) your ability to use the Service, (ii) your satisfaction with the
Service, (iii) that the Service will be available at all times, uninterrupted, and error-free (iv), the accuracy of
mathematical calculations performed by the Service, and (v) that bugs or errors in the Service will be corrected.
Excited Atom are not responsible nor liable for any direct, indirect, incidental, consequential, special,
exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy
for dissatisfaction with the Service is to stop using the Service.
If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining
provisions shall not be impaired thereby.
The failure of Excited Atom to exercise any right provided for herein shall not be deemed a waiver of any right
hereunder. The Terms of Service sets forth the entire understanding between you and Excited Atom as to the
Service and supersedes any prior agreements between you and Excited Atom (including, but not limited to,
prior versions of the Terms of Service).
